The petitioners apprehend their arrest in connection with Nawkothi P.S. Case No.56 of 2019 registered under Sections 307 and 506/34 of the Indian Penal Code besides Section 27 of the Arms Act.

The accusation is that in the morning of 28.05.2019, the informant Ram Kumar Singh alias Akla was returning to his house from his village-Chamartoli along with labourers. When the informant reached near the house of Pulo Jha, then Nitish Kumar fired from his pistol, which passed over through his

Patna High Court CR. MISC. No.54132 of 2019(2) dt.28-08-2019 2/2 head. Thereafter, Hulo Kumar fired through his pistol at the informant, which passed over by the side of his arm. At that time, the petitioners were also present there. Learned counsel for the petitioners submits that while the petitioners are name in the F.I.R. but no specific overt act is attributed to them. The specific allegation of making fire on the informant is against Nitish Kumar and Hulo Kumar. The petitioners have no criminal antecedents.

Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Shri Raghuver Prasad, Judicial Magistrate, First Class, Begusarai, in connection with Nawkothi P.S. Case No.56 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
