JUSTICE SUDHIR SINGH ORAL ORDER 08-02-2023 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sessions Trial No. 672 of 2016 arising out of Muzaffarpur Town P.S. Case No. 264 of 2016 registered for the offence under Section-302/34 of the Indian Penal Code and 27 of the Arms Act.

Earlier prayer for bail of the petitioner was rejected for the reason that there was specific allegation that the petitioner had fired upon the deceased in course of the occurrence.

A report was called for from the trial court. It has been reported that prosecution evidence has already been closed and the case is fixed for defence evidence. Considering the nature of accusation and stage of the

Patna High Court CR. MISC. No.58225 of 2022(3) dt.08-02-2023 2/2 case, I am not inclined to grant bail to the petitioner. Accordingly, prayer for bail of the petitioner is rejected. The trial court is directed to take all necessary steps to conclude the trial at the earliest.
