The petitioner seeks bail in Bakhtiyarpur P.S. Case No. 75 of 2021, registered for the offence under Sections 147, 148, 149, 302 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, on 09.04.2021 at about 8:30 PM, while the deceased was returning home by train, at Champapur halt, two co-accused namely Jitendra Paswan and Lalan Paswan shot him dead.

It is submitted on behalf of petitioner that petitioner is not named in the F.I.R. Name of the petitioner has transpired during course of investigation in the confessional statement of co-accused Kundan Kumar @ Golu Kumar. Specific allegation of firing is against other F.I.R. named co-accused. Save &

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. 1st, Barh, District - Patna in connection with Bakhtiyarpur P.S. Case No. 75 of 2021.
