JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 143,341,342,323,504 and 379 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.

It is alleged that the accused persons came at the chicken and fish shop of the informant and demanded money and on refusal, the accused persons abused the informant by calling caste name and took away five thousand rupees. It is submitted by the learned counsel for the petitioner that on conclusion of investigation the accusation was found false and final form was submitted but differing with the final form,

Patna High Court Cr.Misc. No.35391 of 2015 (2) dt.20-08-2015 2/2 cognizance has been taken. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the fact that the accusation was not found true during investigation, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad in connection with Deo P.S. Case No.91 of 2011 subject to the conditions as laid down under Section 438(2) Cr.P.C.
