NILU AGRAWAL ORAL ORDER 19-08-2015 Heard the learned counsel for the petitioner and the learned counsel for the State.

The petitioner is languishing in jail custody since 06.06.2015 in connection with Gopalganj Nagar P.S. Case No. 211 of 2015 for offences alleged under Sections 379/411 of the Indian Penal Code.

The prosecution case as stated by the informant before the police is that on 05.06.2016 at around 12.15 P.M when the informant was standing, chatting with his friends and his motorcycle BR 06Z 6827 was parked in front of Mahavir X-ray (Ambedkar Chowk) suddenly he saw a man attempting to start his motorcycle using a duplicate key. He also saw the man was taking his motorcycle away then he ran after the man making hue and cry. It has further been alleged that when the informant caught

Patna High Court Cr.Misc. No.33673 of 2015 (2) dt.19-08-2015 2/2 hold of the man along with his motorcycle the man identified himself to be Suraj Kumar Pandey @ Prem Sagar Kumar Pandey. In the meanwhile, the patrolling party arrived at the place of occurrence and the motorcycle along with the accused were taken to the police station when the instant FIR was lodged. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and does not have any criminal antecedent and has been falsely implicated in the present case.

Under such circumstances, let the petitioner, Suraj Kumar Pandey @ Prem Sagar Kumar Pandey be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in Gopalganj Nagar P.S. Case No. 211 of 2015.
