The petitioner has preferred this application for grant of regular bail in a case registered under sections 353, 153, 189, 120B, 504 and 506 of the Indian Penal Code and section 67 of the I.T. Act.

As per the prosecution case, the allegation against the petitioner is of having falsely accused the police personnel of not carrying out their duties properly and of spreading false information on social media. On a raid being conducted, photograph of the petitioner in the uniform of a police personnel with arms was also recovered.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case because of differences between the parties. The nature of

Patna High Court CR. MISC. No.68546 of 2021(2) dt.06-06-2022 2/2 allegation in the F.I.R. itself would show that the prosecution has no case against him. He is in custody since 3.10.2021 and chargesheet has been submitted in the case.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner in the F.I.R., the petitioner being in custody for 8 months and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Forbesganj P.S. Case no.793 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria.
