The petitioner seeks bail in a case registered for the offences punishable under Sections 414 and 120(B) of the Indian Penal Code read with Sections 30(a), 32(2) and 41 of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 14.09.2021, charge-sheet has been submitted in the case and has antecedent of seven cases. Allegation is of recovery of 540 litres of liquor from a pickup van and 63 litres of liquor from a Maruti car. Learned counsel for the petitioner submits that the petitioner was not arrested from the spot and was identified by the chowkidaar with whom he is on an inimical term. It is

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case and was not arrested from the spot, let the petitioner above named be released on bail on furnishing bail bond of Rs. 3,000/- (Rupees Three Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Bachhwara P.S.
