JUSTICE SANJAY PRIYA ORAL ORDER 10-07-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Routa P.S. Case No. 39 of 1995 instituted for the offence under Section 376 of the Indian Penal Code.
The prayer for anticipatory bail of the petitioner was earlier dismissed as withdrawn by a coordinate Bench of this Court vide order dated 11.5.2016 passed in Cr. Misc. 20223 of 2016, and vide order dated 24.3.2014 passed in Cr. Misc. 3538 of 2014 the 2nd anticipatory bail of the petitioner was rejected with a direction to the petitioner to surrender before the court below and make a prayer for regular bail, but he has not surrendered and filed the 3rd application for anticipatory bail.
This Court is not inclined to entertain the anticipatory
Patna High Court Cr.Misc. No.29746 of 2017 (2) dt.10-07-2017 bail of the petitioner as it does not find any fresh ground and merit in this application.
Prayer for anticipatory bail of the petitioner stands rejected.
Petitioner may surrender before the court below within a period of four weeks and make prayer for regular bail which will be considered by the court below in accordance with law without being prejudiced by this order.
