====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 18-09-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks regular bail in a case registered under Sections 30(a), 36 and 41(2) of Bihar Prohibition and Excise Act.
3. As per the prosecution case, 1252.44 litres of illicit liquor was recovered from Pickup vehicle bearing Reg. No. UP61-BT-0048 which was driven by the petitioner.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that petitioner was merely the driver of the vehicle and was only following the instruction of the vehicle owner. He was not

Petitioner has no concern with the seized illicit liquor and nothing has been recovered from conscious possession of the petitioner. There is no independent witness on the seizure list. Petitioner has clean antecedent and there is no likelihood of his absconding or tampering with the evidence. Petitioner is in custody since 18.05.2025 and he undertakes to cooperate in the investigation and trial.
5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case, the submissions of learned counsel for the parties and period of custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise Court-I, Banka in connection with Bounsi P.S.
