JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 27-08-2015 Heard learned counsel for the petitioner as well as learned counsel for the State.

In this application for anticipatory bail the petitioner apprehends her arrest for the offences punishable under sections 147, 149, 323, 324 and 307 of the I.P.C.

Allegedly, the petitioner and other co-accused being variously armed entered into the house of the informant and dragged the informant and his sister-in-law and assaulted and further took away Rs. 5,000/- from the box.

Submission is of false implication and there is case and counter case and due to old enmity the F.I.R. has been lodged. Injuries on petitioner's side as well as informant's side have been found to be simple and similarly situated co-acused Chhote Lal

Patna High Court Cr.Misc. No.35309 of 2015 (2) dt.27-08-2015 2/2 Das @ Chhote Lal Kumar and Sona Devi @ Sonmanti Devi have been allowed pre-arrest bail by another Bench of this Court vide Cr. Misc. No. 35604 of 2015 by order dated 20.08.2015 and as such the petitioner also deserves sympathetic consideration, to which the learned A.P.P. is not in a position to distinguish the case of the petitioner.

In the facts and circumstances as stated above, the petitioner in case of her arrest or surrender within one month from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Gaya in Chandauti P.S. Case No. 124 of 2015, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
