20-07-2017 Heard Sri Udit Narayan Singh, learned counsel assisted by Sri Gajendra Kumar Singh, learned counsel for petitioners and learned Addl. Public Prosecutor. Mother-in-law and father-in-law of the deceased have prayed for grant of anticipatory bail in Darauli P.S. Case No. 82 of 2016 registered for offence under Sections 304(B)/34 of the Indian Penal Code.

It was submitted by learned counsel for petitioners that in the case, husband of the deceased is already facing trial and during trial, none of the witnesses have supported the prosecution case and as such, according to him, it is a fit case for extending the privilege of anticipatory bail.

No.33123 of 2017 (2) dt.20-07-2017 2/2 However, considering the allegation made in the F.I.R., which suggests that death of daughter of informant had occurred within seven years from the date of marriage and dead body was also disposed of without any intimation to the informant, the Court is of the opinion that it is not a case for extending the privilege of anticipatory bail.
