JUSTICE MOHIT KUMAR SHAH ORAL ORDER 15-04-2024 The present writ petition has been filed seeking the following relief:- "That this is an application for issuance of an appropriate writ and/or order and/or direction commanding the respondents to refund the amount of Rs. 3.82.201/- which has deducted from gratuity in view of pay fixation by Finance Department and implementation of order Vide memo nо. 4447 dated 06.12.2017 whereby and whereunder the scale of P.B.3+ Grade pay 6600

Patna High Court CWJC No.14338 of 2023(2) dt.15-04-2024 2/2 which was granted to the petitioner by way of his 2nd financial progression under MACP Rules, 2010, has been revised /modified and in place of above scale i.e. PB3+Grade pay 6600, the petitioner has been granted the scale PB3+Grade pay 5400 in view of the advisory issued by the Finance Department, Govt. of Bihar vide its letter no. 3655 dated 10.04.2015 in a mechanical manner."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to file appropriate petition under the Contempt Jurisdiction of this Court for violation of the judgment dated 12.12.2022, passed by a co-ordinate Bench of this Court, in CWJC No.24702 of 2018. Liberty so sought is granted.

The writ petition stands disposed off as not pressed.
