The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273, 290 of the Indian Penal Code and 47(a) of Excise Act. Twenty litres country made liquor were recovered from the house of the petitioner.
It is submitted by learned counsel for the petitioner that the recovery has been made from the house of father-in-law of the petitioner and a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the quantity of recovery, let the
Patna High Court Cr.Misc. No.33530 of 2015 (2) dt.28-08-2015 2/2 learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Paraiya P.S. Case No. 38 of 2015 pending in the court of learned Judicial Magistrate, Ist Class, Gaya.
With the aforesaid observation, this application is disposed of.
