Considering the stand taken by the petitioner, the application is being disposed of at this stage.
Petitioner served the respondent Water Board, Gaya and under the order of the Municipal Commissioner, Gaya Municipal Corporation (respondent no. 4), he was made to superannuate from service on 31.7.2011. As none of his post retiral dues could be paid, he made representation which was not heeded to and hence the writ petition.
It is stated that the petitioner on retirement is entitled to payment of pension, leave encashment, provident fund amount, group insurance amount, gratuity as also the arrears of pension. None of the
Patna High Court CWJC No.10941 of 2015 dt.16-05-2016 2/2 aforesaid dues, till date, has been paid/authorized in favour of the petitioner.
Counsel for the petitioner states that the application may be disposed of permitting the petitioner to raise a grievance in this regard before the Municipal Commissioner, Gaya Municipal Corporation ventilating the aforesaid grievance(s) who may be directed to examine/consider the same.
Having heard the parties, the writ application is disposed of permitting the petitioner to file a representation for payment of admissible retiral dues to the petitioner upon superannuation before the respondent no. 4 for its consideration and disposal in accordance with law. If any such application is filed within four weeks along with all relevant documents as well as a copy of the present order, the respondent no. 4 will examine/consider the same and take appropriate decision and pass appropriate order in accordance with law as quickly as possible preferably within two months of such presentation/filing.
