JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was neither caught on the spot nor anything was recovered from his conscious possession and it appears that his name was disclosed by the co-accused, who were nabbed on the place of occurrence. Moreover, co-accused, Md. Chand, from whose house the alleged recovery has been made, has already been granted privilege of bail.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with
