The petitioners apprehend their arrest in Nalanda P.S. case No. 64 of 2016 under Section 307 and other Sections of the Indian Penal Code.

The petitioner No.1, Sulo Ram, is alleged to have assaulted Sukhdeo Prasad, the informant, with iron rod and Aman Shekhar, petitioner No.2, is alleged to have assaulted Bebi Devi with Khanti.

It is submitted that there is counter version and Bibha Kumari, wife of co-accused, Upendra Ram, filed complaint case No. 545C/2016 on 01.06.2016 under Section 354, 307 and other Sections of the IPC. The informant, Sukhdeo Prasad, and Bebi

Patna High Court Cr.Misc. No.41380 of 2016 (2) dt.11-11-2016 2/2 Devi got simple injuries.

Considering the fact that there is case and counter case and the injuries sustained by informant and Bebi Devi, on account of assault made by the petitioners, are simple in nature, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in Nalanda P.S. Case No. 64 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
