ANJANA MISHRA ORAL ORDER 16-10-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 20.07.2018 in connection with Special Case No.76 of 2018 arising out of NCB Case No.35 of 2018 registered for the offence under Sections 8/20/23/25/27A/29 of the N.D.P.S. Act, 1985, which is pending in the court of learned A.D.J.-IV, Patna. Learned counsel for the petitioner submits that the petitioner is merely the Driver of the vehicle and not the owner and has no knowledge of the contraband being loaded in the vehicle. It is further submitted that the petitioner is languishing in jail for over a year and he is the sole breadearner.

Patna High Court CR. MISC. No.56803 of 2019(2) dt.16-10-2019 2/2 Learned counsel for the Union of India submits that in view of the recovery of huge commercial quantity to the tune of 142 Kg. of narcotics substance, the petitioner does not deserve to be granted bail.

Having considered the recovery of huge quantity of narcotics substance from the possession of the petitioner, I am not inclined to grant regular bail to the petitioner. It is, accordingly, dismissed.

However, let the trial of the case be expedited so as to conclude positively within a period of six months from today.
