Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 419, 420, 467, 468, 471 of the Indian Penal Code.
It is alleged that petitioner being Chairman of Hasanpura PACS, Sadar, Ara purchased paddy from Suresh Kumar, Tej Narain Yadav, Sanjay Singh without verification of their land possession documents.
It is submitted by learned counsel for the petitioner that procurement certificates were issued by the Circle Officer and petitioner being Chairman of the PACS has no occasion to verify the certificate issued by the Circle Officer. It is not in dispute that paddy was not purchased and the consideration amount has not been paid to the farmers by
Patna High Court Cr.Misc. No.37219 of 2015 (2) dt.14-09-2015 2/2 procurement centers.
Considering the nature of accusation, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bhojpur, Ara in connection with Ara (Muffasil) P.S. Case No. 217 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
