JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-07-2017 Heard learned counsel for the petitioners and the learned counsel for the State.

This application has been filed by the petitioners for modification in the order dated 24.02.2014 passed in Criminal Misc. No. 48346 of 2013 by this court with regard to extend the period of surrender of the petitioner in the court below. Learned counsel for the petitioners submits that vide order dated 24.02.2014 passed in Criminal Misc. No. 48346 of 2013, the petitioners were ordered to be released on bail, in the event of arrest or surrender within four weeks from the date of receipt/production of copy of the order, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate Ist Class, Araria,

Patna High Court Cr.Misc. No.29958 of 2017 (2) dt.20-07-2017 in connection with Complaint Case No. 1775 of 2012, subject to the conditions laid down under Section 438(2) Cr.P.C. But the petitioners, Mayarakhi Devi and Rameshanand Jha could not surrender within the stipulated period due to personal difficulties. In that view of the matter, learned counsel for the petitioners prays for extension of period of surrender of the petitioner in the court below.

Considering the submission of the learned counsel for the petitioners, the period of surrender of the petitioners in connection with the aforesaid case in the court below is further extended for four weeks from today and this applications is, accordingly, allowed with the aforesaid modification in the order dated 24.02.2014 passed in Criminal Misc.
