ANJANA PRAKASH ORAL ORDER 20-04-2016 Heard learned counsel for the Petitioner and the State. The Petitioner seeks bail in Ghorasahan P.S. case No.134 of 2009 instituted for the offence under Sections 147, 148, 149, 307, 302 of the Indian Penal Code and 27 of the Arms Act, pending in the court of Sub Divisional Judicial Magistrate, East Champaran at Motihari.

From the report of the Trial Court i.e. Additional Sessions Judge-14, Motihari, East Champaran, it appears that the Petitioner is being separately tried and he had not appeared after the Court disagreed with the final report.

In such circumstances, I would direct that the Trial Court amalgamate the present trial (Sessions Trial No.403 of 2015) with that of co-accused so that there is no further delay in

Patna High Court Cr.Misc. No.36154 of 2015 (3) dt.20-04-2016 2/2 trial.

Learned Counsel for the Petitioner submits that he will accept the evidence of the witnesses, who have already been examined.

The Informant undertakes that he will produce the witnesses regularly without delay.

The application stands disposed of with the aforesaid observations.
