JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 379, 411 of the Indian Penal Code.

Petitioner is in jail custody since 07.07.2016 on the accusation that he as well as co-accused having snatched the cash from informant tried to flee from there but petitioner was caught on the spot whereas co-accused managed to escape from there. Submission on behalf of the petitioner is that only ATM card as well as mobile phone, which belong to petitioner, are said to have been recovered from his conscious possession and so far as snatched cash is concerned, the same was not recovered

Patna High Court Cr.Misc. No.40536 of 2016 (2) dt.03-10-2016 2/2 from possession of the petitioner. It is further submitted that as a matter of fact, a hot exchange of words took place between petitioner and informant on the point of withdrawal of cash from ATM and informant with exaggerated story lodged this case against the petitioner and others. Moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since long.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Nawada P.S. Case No. 449 of 2016.
