JUSTICE SHIVAJI PANDEY ORAL ORDER 19-07-2017 Heard learned counsel for the petitioners and learned counsel for the State.

In this case, the petitioners are seeking anticipatory bail in connection with Barauni (Garhara) P.S. Case No.380 of 2016, registered for the offence punishable under Sections 341, 324, 307 and 120B/34 of the Indian Penal Code and under Section 27 of the Arms Act.

As per the F.I.R. the informant had gone to give her evidence in Phulwaria P.S. Case No.163 of 2014, in the Court itself the petitioner no.2 threatened her that if she gives the evidence in the case, then she will face the same consequence as has been faced by her husband and son-in-law. While the

Patna High Court Cr.Misc. No.20893 of 2017 (4) dt.19-07-2017 2/2 informant was returning to her house, she was intercepted and on the order of the petitioners one Amit Tiwari fired twice on her, which caused injury on the thigh of the informant. Learned counsel for the petitioners submits that at best the petitioners are the order givers, having not played any active role in causing harm to the informant. Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioners. Accordingly, the prayer for bail is rejected.
