JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 12-06-2020 It is submitted by the learned counsel for the petitioner that during pendency of the present application preferred under Section 438 of the Code of Criminal Procedure for grant of pre-arrest bail to the petitioner in connection with Motihari Mufasil P.S. Case No.10 of 2012 dated 08.01.2012 registered inter alia under Section 366 of the Indian Penal Code, the police have submitted a report under Section 173 of the Code of Criminal Procedure wherein the petitioner has not been sent up for trial. He submitted that in that view of the matter, this application has become infructuous.

In view of the submission made above, the application is dismissed as infructuous.
