1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners seek bail in a case registered for the offence punishable under Sections 341, 323, 324, 307, 379, 504, 506 and 34 of the Indian Penal Code.
3. Learned counsel for the petitioners submits that petitioner no.1, 2 and 3 have antecedent of one case and petitioner no.4 and 5 are persons with clean antecedent. It is next submitted that similarly situated co-accused Pawan,
Patna High Court CR. MISC. No.61560 of 2024(2) dt.27-09-2024 2/2 Sonelal, Saukhi Rai, Ramsuhag Rai and Ram Rekha Rai had approached this court seeking anticipatory bail by filing Cr. Misc. No. 58821/2024 and the same was allowed by an order dated 26.09.2024. It is further submitted that petitioners are even similarly situated like Pawan and four others. It is next submitted that the court after considering the case of Pawan and others on merits was pleased to grant anticipatory bail. It is next submitted that petitioners are in custody, thus the learned counsel seeks bail for the petitioners.
4. Learned A.P.P. for the State opposes the prayer for bail of the petitioners.
5. Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Sitamarhi, in connection with Dumra P.S.
