JUSTICE SUDHIR SINGH ORAL ORDER 08-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 363, 366A and 34 of the Indian Penal Code. Allegation against the petitioner is of kidnapping daughter of the informant.

It has been submitted on behalf of the petitioner that he is in custody since 2.6.2015. He has got no criminal antecedent. Chargesheet has been submitted against the petitioner. There is no allegation of tampering with the evidence against the petitioner. From perusal of Annexure-2 it would appear that the victim had filed a petition against her father where she has alleged that her father forcibly wanted to get her married to another person whereas she desired to get married with the petitioner. From Annexure-4 it would appear that the victim and petitioner have already married and leading a conjugal life.

On behalf of the State, it is submitted that the petitioner is

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Purnea, in connection with Bhawanipur P.S. Case no. 132 of 2014.
