JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 12-02-2016 Heard learned counsel for the petitioner as well as learned APP.

Learned APP has submitted that petitioner has been produced in this case and 25.02.2016 has been fixed as a next date. At an earlier occasion, prayer for bail of the petitioner along with Kamlesh Kumar Singh @ Kamal Singh was rejected by order dated 13.10.2014 passed in Cr.Misc Nos. 15916/2014 and 22645/2014 conjointly.

Prayer has been renewed in the background of having a co-accused along with Ram Naresh Singh released on bail vide Cr. Misc Nos. 15449/2015 and 47935/2012 respectively. Furthermore, from para-3 of the petition, it is evident that petitioner happens to be an accused in one more case. It is also apparent that petitioner is under custody since 26.12.2012.

No.42734 of 2015 (5) dt.12-02-2016 In the aforesaid facts and circumstances of the case, petitioner, Rajiv Kumar Yadav @ Rajiv Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of ACJM, Patna City in connection with Alamganj PS Case No. 215 of 2012 corresponding to GR No. 1638 of 2012 subject to the condition that petitioner will not indulge himself directly or indirectly in coercing, threatening and alluring the victim/informant till his evidence is recorded and in case, so reported, the learned lower court will be at liberty to pass an appropriate order even the extent of cancellation of bail.
