JUSTICE MUNGESHWAR SAHOO ORAL ORDER 17-10-2016 Heard the learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners, namely Smt. Soni Devi and Lal Babu Yadav, husband of petitioner No.1 apprehend their arrest in Gandhi Maidan P.S. Case No.83 of 2016 under Section 304(B), 34 of the Indian Penal Code and 3/4 of Dowry Prohibition Act. The learned counsel for the petitioners submitted that the petitioner No.1 is the elder sister of the husband of the deceased whereas the petitioner No.2 is the husband of petitioner No.1 i.e. the petitioners are Nanad and Nandoi of the deceased and admittedly they reside at Digha whereas the Maikey of the petitioner No.1 is at Gandhi Maidan where the dead body was

Patna High Court Cr.Misc. No.41855 of 2016 (2) dt.17-10-2016 found and the husband of the deceased is already in jail. Considering the fact that the petitioners are Nanad and Nandoi and the petitioner No.1 is the elder sister of the husband of the deceased and is married lady who is residing in her sasural with family, I direct the petitioners named above to surrender before the court below within one month from today and on their so surrendering, the petitioners shall be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Patna in connection with Gandhi Maidan P.S. Case No.83 of 2016.
