JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-09-2018 The petitioner is apprehending his arrest in connection with Marhowrah P.S. Case No. 93/2018, registered for offences punishable under Sections 304(B) and 201/34 of the Indian Penal Code.

Allegation against the petitioner, who happens to be the husband of the deceased, is of demand of dowry and causing death of his wife and disposed of the dead-body of the deceased without informing the father of the deceased.

Submission of learned counsel for the petitioner is that the deceased was suffering from heart disease and due to that she died and dead-body was disposed of in presence of the informant. However, on instigation of the villagers, this present false case has been lodged by the informant.

Patna High Court Cr.Misc. No.49319 of 2018 (4) dt.10-09-2018 2/2 Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant privilege of anticipatory bail to the petitioner rather he should surrender before the court below and make prayer for regular bail, which would be considered on its own merit.

Accordingly, this application is dismissed.
