JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-11-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor, appearing on behalf of the State. Petitioner apprehends his arrest in connection with Dariyapur P.S. Case No. 18 of 2015, registered for offences punishable under Section 384/34 of the Indian Penal Code. Accusation against the petitioner is that he along with three others were forcibly collecting donation on the eve of Saraswati Puja. Admittedly, neither petitioner was caught on the place of occurrence nor anything was recovered from his conscious possession. The name of the petitioner surfaced only on account of confessional statement made by co-accused, who was caught by the informant on the spot.

Accordingly, it is ordered that the petitioner above

Patna High Court Cr.Misc. No.43492 of 2016 (2) dt.28-11-2016 2/2 named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -IV, Saran at Chapra in connection with Dariyapur P.S. Case No. 18 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) sunil/- U T
