The petitioner seeks bail in a case registered under Sections 376, 420 & 34 of the Indian Penal Code and Section3/4 of Dowry Prohibition Act. Prosecution case, in short, is that on the false pretext of marriage, the petitioner established physical relationship with the victim and later on, he refused to solemnize marriage with the victim.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 02-05-2019. Charge sheet has already been submitted. It is alleged that on the false pretext of

Patna High Court CR. MISC. No.56706 of 2019(2) dt.09-09-2019 2/2 marriage, sexual relationship was established between the parties. The said physical relationship between the parties was consentual. In support of his contention, the petitioner has relied upon the order passed by the Apex Court in Cr. Appeal No. 1443 of 2018.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Mahila P.S. Case No. 27 of 2019 (Sudhir Singh, J) A.K.V.//- U T
