The petitioner seeks anticipatory bail in a case instituted for the offences under Sections 47(A) of the Bihar Excise Act. The police on secret information has raided Mahadeba village and from the deserted field 15 liters of wine has been recovered.
Learned counsel for the petitioner submits that petitioner has no connection with the liquor. On the day of occurrence he was not even present in the village and he has no criminal antecedent.
Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today,
Patna High Court Cr.Misc. No.23895 of 2017 (2) dt.01-07-2017 let petitioner, namely, Surendra Chaudhary, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, IV, Nawada in connection with G.O. Case No.598 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
It is made clear that if the petitioner would commit similar type of offence, the prosecution will be at liberty to cancel the bail of the petitioner.
