This application for anticipatory bail arises out of Kiul P.S. Case No. 45 of 2019 for the offence punishable under Sections 337, 338, 332, 333, 353, 307, 379 and 411/34 of the Indian Penal Code and Section 4/40 of Bihar Minor Mining Concession Act, 1972 and Secti9on 4, 6, and 8 of Bihar Central of Prevention of Illegal Mining Transportation and Storage Rules, 2003 and Section 15 of Environment Act, 1986. Considering the submission that similarly circumstanced co-accused, Dayanand Kumar, has been allowed anticipatory bail by this Court by order dated 16.08.2019 passed in Cr. Misc. No. 50861 of 2019, this application is allowed. Let the petitioner above named, in the event of her arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten
Patna High Court CR. MISC. No.54091 of 2019(2) dt.30-08-2019 2/2 Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Lakhisarai, in Kiul P.S. Case No. 45 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present herself before the Police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bonds shall be liable to be cancelled.
