The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 379 of the Indian Penal Code.
Prosecution case is that the informant and his family members were returning home after labour work, the First Information Report named accused persons made assault. The accused persons also snatched gold chain and Rs.20,000/- from the informant.
It is submitted by the learned counsel for the petitioners that injuries of the informant's side have been found
Patna High Court Cr.Misc. No.36100 of 2015 (2) dt.07-09-2015 simple except injury on the wrist of Md. Nizam, which is found to be grievous. There is counter version of the occurrence and petitioners' side Md. Israful has received grievous injury on his head. The accusation of assault is omnibus and general. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sri P.Shankar, Judicial Magistrate, Ist Class, Banka in connection with Dhoraiya P.S. Case No. 105 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. (Dinesh Kumar Singh, J) P.K./- U T
