The petitioner seeks pre-arrest bail in connection with Maniyari P.S. Case No.139 of 2016 registered under Sections 341, 323, 325, 326, 307, 498-A/34 and 304-B of the Indian Penal Code. However, in course of investigation Section 302 of the Indian Penal Code was added.
Keeping in mind the serious nature of allegation that petitioners sprinkled Kerosene oil and set the informant Sharmila Devi on fire as a result of which she badly injured and in course of treatment she died, I am not inclined to grant pre-arrest bail to the
Patna High Court Cr.Misc. No.25124 of 2017 (2) dt.01-07-2017 2/2 petitioners.
Accordingly, the prayer for pre-arrest bail of the petitioners is rejected.
