2. This application is filed for modification of order dated 25.07.2025, passed in Cr. Misc. No. 35978 of 2025.
3. Learned counsel appearing on behalf of the petitioner has submitted that the petitioner has been granted anticipatory bail 25.07.2025, passed in Cr. Misc. No. 35978 of 2025, by which the petitioner was granted anticipatory bail with a direction to surrender before the Court below within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand)
Patna High Court CR. MISC. No.58653 of 2025(2) dt.20-08-2025 2/3 with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-XII, East Champaran, Motihari in connection with Muffasil Motihari P.S. Case No. 471 of 2023, subject to conditions as laid down under section 482(2) of the B.N.S.S., 2023. Learned counsel has further submitted that in the prayer portion of the bail petition, the description of the Court below has wrongly been typed as "to the satisfaction of Learned Additional Sessions Judge-XII, East Champaran, Motihari" instead of "to the satisfaction of learned C.J.M., East Champaran, Motihari" due to which, the petitioner could not furnish/surrender the bail bond before the learned Court below within the stipulated time.
4. In view of the above, let the order dated 25.07.2025, passed in Cr. Misc. No. 35978 of 2025, in the paragraph no.6 of the said order, be read as learned C.J.M., East Champaran, Motihari in place of learned Additional Sessions Judge-XII, East Champaran, Motihari and the time be further extended by four weeks for furnishing the bail bond/surrender to the petitioner before the learned Court concerned from the receipt of this order.
5. Accordingly, the modification application is allowed and the order dated 25.07.2025, passed in Cr. Misc. No.
Patna High Court CR. MISC. No.58653 of 2025(2) dt.20-08-2025 3/3 35978 of 2025 is modified to the above extent. (Chandra Prakash Singh, J) Shivam/- U T
