The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 304B, 201/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
The petitioner is husband of the victim of dowry death. The daughter of the informant died within four years of her marriage in her matrimonial house in unnatural circumstances. Allegation is of demand of dowry and torture for the same. Learned counsel for the petitioner submits that the informant has filed a petition before the court below that under some misinformation, the FIR has been lodged. Considering the nature of allegation and presumption
Patna High Court Cr.Misc. No.31367 of 2018 (6) dt.28-09-2018 2/2 against the petitioner, I am not inclined to enlarge him on anticipatory bail in connection with Shakurabad P.S. Case No. 33 of 2018 pending in the court of learned Additional Chief Judicial Magistrate-cum-Sub Judge-I, Jehanabad.
However, prayer of the petitioner for regular bail, in the event of surrender within three weeks, shall be considered without being prejudiced by this order and considering the petition of the informant filed in this case.
