Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Hussainganj P.S. Case No. 61 of 2021, for the offences under Sections 147/148/149/341/323/324/325/326/379/504 of the Indian Penal Code.
As per allegation, the specific allegation against the petitioner is that he assaulted Gautam Yadav with sword on his head but the injuries found on the head of Gautam Yadav are
Patna High Court CR. MISC. No.68218 of 2021(2) dt.02-06-2022 2/3 simple in nautre. One grievous injury on the shoulder of the Gautam Yadav was found but it is not attributed against the present petitioner.
Learned counsel for the petitioner has further submitted that the informant's side has badly assaulted the members of the petitioner's side in which father of the petitioner has sustained grievous injury. In counter case, accused person has been granted anticipatory bail in Cr. Misc. No. 67770/2021. He has further submitted that petitioner is a person of clean antecedent.
Considering the above mentioned facts and circumstances, especially the fact that there is case and counter case and the injuries specifically attributed against the petitioner are simple in nature, the petitioner above named, in the event of their arrest or surrender, within four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Learned A.C.J.M., IX, Siwan, in connection with Hussainganj P.S. No. 61/2021, subject to condition as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove,
