JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 09-02-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Basantpur (Lakdi Nabiganj) P.S. Case No. 314 of 2022, registered for the offences punishable under Section 392 of the Indian Penal Code.

As per allegation, four accused persons looted Rs. 3, 78,800/- from the CSP of the informant.

The learned counsel for the petitioner has submitted that petitioner is not named in the FIR. Nothing was recovered from the petitioner or from co-accused Kaif Ali, who was arrested and in whose confessional statement, the name of the petitioner has figured. The petitioner is a person of clean

Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Basantpur (Lakdi Nabiganj) P.S. Case No. 314 of 2022, subject to condition as laid down under section 438(2) Cr. P.C. If the petitioner is involved in any other case of similar nature, the learned court below shall be at liberty to cancel his bail bond.
