Petitioners apprehend their arrest in connection with Mojahidpur (Babarganj) P.S.Case No. 40 of 2017 registered for the offences punishable under Sections 363 and 365/34 of the Indian Penal Code.

Allegation against the petitioners is of kidnapping of son of the informant.

Submission of learned counsel for the petitioners is that except suspicion there is nothing against the petitioners. Heard learned APP also, who has opposed the prayer for anticipatory bail stating that the boy is still traceless and petitioners were seen along with the victim boy which will appear

Having heard both sides and in the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioners, rather petitioners to surrender and make prayer for regular bail, which shall be considered on its own merit.
