2. The petitioner apprehends arrest in connection with Khiri More P. S. Case No. 111 of 2022, dated 10-11-2022 instituted for the offence punishable under Sections 147,148,149, 341,323, 325, 307, 379, 337, 338 of the Indian Penal Code and Section 27 of the Arms Act. Later on Section 302 of the IPC was added in the instant case.
3. In the background of a land dispute accused persons including the petitioner, who is agnate of the informant, have assaulted the informant and his family members. It is alleged that this petitioner along with co-accused Sarswati Devi have
Patna High Court CR. MISC. No.63726 of 2023(3) dt.06-12-2023 2/3 assaulted the informant and his family members by means of 'Khanti'(Garasa) and bricks.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. It is further submitted that FIR has been lodged against 10 accused persons including the petitioner. There is specific allegation against co-accused, namely, Om Prakash Yadav that he assaulted Awadhesh Yadav on his head by means of 'Bhala'. There is no specific allegation against the other co-accused persons. There is case and counter case between the parties. There is admitted land dispute between the parties. The petitioner has no criminal antecedent. Petitioner is a lady aged about 44 years.
5. Learned A.P.P. for the State has opposed the prayer for bail of the petitioner.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioner within a period of six weeks from today, in connection with Khiri More P. S. Case No. 111 of 2022, she shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned
