JUSTICE RAKESH KUMAR ORAL ORDER 06-12-2016 Heard Sri Raju Kumar, learned counsel for the petitioner and Sri Madan Kumar, learned Addl. Public Prosecutor. The petitioner, who is in custody since 19.03.2016 in Muzaffarpur Sadar P.S. Case No.159 of 2016 registered for the offence under Section 395 of the Indian Penal Code, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. He has also placed reliance on an order passed by a Bench of this Court, whereby one of the co-accused, from whose possession looted bags of rice were recovered, has already been enlarged on bail.

No.40941 of 2016 (3) dt.06-12-2016 2/2 However, after going through the material on record, it is evident that the petitioner's name has come on the basis of confession of co-accused and the confession has led to recovery of looted articles. Besides the present case, the petitioner is also accused in other three serious cases. Accordingly, I do not find any ground to extend the privilege of bail. The petition stands dismissed.
