The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,341,323,354,379 and 504 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.
The prosecution case is that for making protest for constructing boundary wall on the land of the informant, wife of the informant was assaulted and abused by calling caste name. It is submitted by the learned counsel for the petitioner that in the background of land dispute the accusation has been
Patna High Court Cr.Misc. No.34527 of 2015 (2) dt.02-09-2015 2/2 levelled. It is further submitted that for the occurrence of 29.8.2014 the FIR was registered on 2.9.2014 when the petitioner side lodged a case on 2.9.2014 itself.
Considering the delayed lodging of the case and the accusation levelled in the background of land dispute, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gaya in connection with Khizar Sarai P.S. Case No. 165 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
