Petitioners apprehend their arrest in connection with a case registered under Sections 147, 149, 341, 323, 324, 307, 384, 504 of the Indian Penal Code.
Allegation in brief is that due to land dispute and in attempt to take possession the accused persons alleged to have assaulted the informant and others.
Submission is that due to land dispute, these two petitioners have been falsely implicated. There is no specific allegation of assault against petitioner no.1, a lady and the allegation against petitioner no.2 of giving iron rod blow at the back of the informant but no such corresponding injury was found.
Patna High Court Cr.Misc. No.30092 of 2017 (2) dt.06-07-2017 2/2 The specific allegation of assault by sharp cutting weapon is against other accused. These petitioners have no criminal antecedent.
Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Arti Devi @ Amrita Devi @ Amirti Devi and Rambilash Mandal be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of J.M.Ist Class, Madhubani in connection with Raj Nagar P.S. Case No.232 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Arun Kumar, J) N.H./- U T
