He seeks permission of the Court to withdraw his application.
In view of the submissions of the learned counsel for the petitioner, the prayer for anticipatory bail of the petitioner no. 2 (Md. Manaj) is hereby dismissed as withdrawn. Heard both sides.
The petitioner is apprehending his arrest in connection with Nasriganj P.S. Case No. 34 of 2017 for the offence registered under Sections 376 and 420 of the Indian Penal Code. The informant has alleged that the son of this petitioner
Patna High Court Cr.Misc. No.29284 of 2017 (2) dt.01-07-2017 2/2 established physical relationship on the pretext of marriage. But he refused to marry, wherafter the informant went at the place of this petitioner where she was abused and threatened. The learned counsel for the petitioner submits that the allegation is specific against the son of this petitioner. The only allegation that has come against the petitioner is that he refused to marry his son with the informant. This petitioner has no concern with the affairs of his son.
The learned APP opposed the prayer of anticipatory bail. Considering the facts that this petitioner is father of main accused having omnibus allegation, his prayer of anticipatory bail is allowed and the petitioner (Md. Jamaluddin), in the event of arrest/surrender within four weeks from today is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned S.D.J.M. Bikramganj Rohtas in Nasriganj P.S. Case No. 34 of 2017 subject to the condition as laid down under Section 438(2), the code of Criminal Procedure. (Sanjay Kumar, J) rohit/- U T
