The petitioner has preferred this application for grant of regular bail in a case registered under sections 461, 379, 411 and 34 of the Indian Penal Code.
As per the prosecution case, a premises was let out by the petitioner to the informant where he was running a godown having stored electronic goods. A theft of articles worth Rs. 50 lcas took place and it is stated that subsequently it transpired that it was the petitioner and others who are selling the stolen articles.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case
Patna High Court CR. MISC. No.68774 of 2021(2) dt.17-05-2022 2/2 because of his dispute relating to arrears of rent between the landlord and tenant, the informant being the tenant. Even accepting the allegations levelled, at best the petitioner may be said to be in possession of the stolen property. There is no eye witness to the alleged occurrence. The petitioner is in custody since 17.6.2021 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the nature of allegation together with the petitioner having remained in custody for more than 10 months, not having any criminal antecedent and investigation in the case having concluded, the petitioner is directed to be enlarged on bail in connection with Raghopur P.S. Case no. 152 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Birpur, District Supaul.
