The petitioners apprehend their arrest in connection with Lalganj P.S. Case no. 51 of 2019, registered under Sections 147, 148, 149, 341, 323, 324, 307, 379, 427, 385, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
The accusation is that on 09.02.2019, while informant Sonu Kumar was on his shop in the name of Sonu Max Computer situated in front of State Bank of India, Lalganj, in the meantime, six persons named in the F.I.R. including the petitioners, and 20 to 25 unknown having armed with lathi, danda, knife and gun came there and started demanding Rs. 50,000/- as ransom. When informant denied to fulfill the demand then petitioners and others caused injury to
Patna High Court CR. MISC. No.56193 of 2019(2) dt.04-09-2019 2/2 informant and they also made firing. At that time, co-accused Vikash Kumar, Arun Kumar and Babu Kumar looted Rs. 87,000/- kept in cash box and others looted Laptop, computer and other electronic articles.
Learned counsel for the petitioners submits that, in fact, informant, who is running the computer shop used to collect the children of the locality for showing dirty films, Due to that reasons, the Mohalla people raised objection several times, but with ulterior motive the informant lodged the present case with false allegation that petitioners and others made demand of ransom and committed loot in his shop. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali in connection with Lalganj P.S. Case No. 51 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
