JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 24-08-2022 Heard learned counsel for the petitioner and learned APP for the State and perused the case diary. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 304(B) and 201/34 of the Indian Penal Code.
It is a case of dowry death due to non-fulfilment of dowry demand and the petitioner happens to be the husband of the deceased.
It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the deceased died due to diarrhoea. Petitioner has clean antecedent.
Learned APP appearing for the State opposed the anticipatory bail of the petitioner and submitted that the
Patna High Court CR. MISC. No.68451 of 2021(3) dt.24-08-2022 2/2 petitioner is the husband of the deceased and whole responsibility is fixed upon the husband of the deceased. The Postmortem report as mentioned in para-35 of the case diary shows the cause of death is asphyxia, which is in consonance with the prosecution case, and the prosecution witnesses have aslso supported the case of the prosecution.
After consideration the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner is rejected.
