All the petitioners, except petitioner no. 7, are facing accusations punishable under Section 498A and 34 of the Indian Penal Code vide Bettiah Town P.S. Case No 368 of 2016. Petitioner no. 7 is a distant relative of the husband. It is submitted that the after the marriage of the informant in the year 2013 with co-accused Israrul Hoda,, it has been alleged that she has been subjected to torture on account of non-fulfilment of dowry. Counsel for the petitioners, referring to the order dated
Patna High Court Cr.Misc. No.21102 of 2017 (2) dt.01-07-2017 2/2 07.03.2017 passed in Cr. Misc. No. 54409 of 2016 (AnnexureP/2), submits that the husband has been granted anticipatory bail. The petitioners have no criminal antecedent. The accusations made in the F.I.R. has been denied by them.
Considering the facts and circumstances of the case, in the event of arrest or surrender in the Court below within four weeks, the petitioners abovenamed are directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah, West Champaran in Bettiah Town P.S. Case No. 368 of 2016 subject to the condition as laid down under Section 438(2) of the Cr.P.C. with further condition that one of the bailers shall be the own/close family members of the petitioners.
