JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT Date : 03-12-2018 The writ petition has been filed for quashing of the result/panel of Lecturers published by A.N.Sinha Institute of Social Studies, Patna dated 29.07.2010 (Annexure-4) containing the list of selected candidates in different faculties.
2. It has been submitted that the petitioner who had applied for the post of Lecturer in the discipline of
Patna High Court CWJC No.19 of 2011 dt.03-12-2018 2/3 Psychology has not been appointed/selected. In fact, nobody in the discipline of Psychology was selected.
3. The learned counsel appearing for the A.N. Sinha Institute of Social Studies, Patna has submitted before this Court that the Institute is an autonomous body created under the Anugraha Narayan Sinha Institute of Social Studies Act, 1964 which is not subordinate to the State Government but only derives its financial substance from the grants of the State Government as well as of the Indian Council of Social Science Research, New Delhi.
4. A Board of control of the Institute determines the governance of the Institute and exercises all the powers in that regard. A rigorous pattern has been formulated by the Institute for the purposes of appointing the Lecturers and Readers as the Institute does not impart any teaching but only facilitates research in various disciplines.
5. In view of the aforesaid decision of the Board of Control with respect to the pattern of selection/appointment, an advertisement was issued in the year 2010 inviting applications for various posts in various
Patna High Court CWJC No.19 of 2011 dt.03-12-2018 3/3 disciplines of Social Sciences.
6. The forms submitted by the candidates were scrutinized by the Screening Committee and thereafter Interview was taken at three stages.
7. For the discipline of Psychology, no candidate was found suitable and hence, no appointment was made.
8. The petitioner, therefore does not have any rightful claim over any post even if it is vacant in the discipline of Psychology in the aforesaid Institute.
9. There is no merit in this application and the same is dismissed.
