JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,447,323,307,379 and 504/34 of the Indian Penal Code.

In the background of land dispute when the informant was sowing paddy seedlings in the field, protest was made by Bhikhari Yadav when petitioner and others assaulted with lathi and danda when brother of the informant Sukdeo Yadav and his son in law came to rescue they were also assaulted. It is further alleged that co accused Ramadhar Yadav took away five thousand rupees from the pocket of the informant.

It is submitted by the learned counsel for the petitioner

Patna High Court Cr.Misc. No.35778 of 2015 (2) dt.04-09-2015 2/2 that except one injury for which the injured was treated other injuries have been found to be simple. The accusation is omnibus and general and there is counter version of the occurrence also. It is further submitted that in the background of pending title suit the accusation has been levelled. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Motihari in connection with Sugauli P.S. Case No.195 of 2010 subject to the conditions as laid down under Section 438(2) Cr.P.C.
